The petitioner/A1 seeks anticipatory bail in Crime No.12/AC/ 2023 registered by the respondent police for the offences punishable under Sections 120B, 409, 477-A and 201 of IPC and under Section 13(2), 13(1)(c) and (d) of the Prevention of Corruption Act 1988 with respect to an occurrence which took place on 17.11.2023.

2. The respondent will have to re-examine the provisions of law indicated in the first information report since, the Prevention of Corruption Act has been amended in the year 2018 and irrespective of the amendments, FIR has been registered.

3. Be that as it may, the petitioner/A1 was a Panchayat Secretary, in Bukkampatty Village, Mecheri Block, Salem District between 1997 and 2018.

4 . Learned counsel for the petitioner states that he subsequently had also been promoted as Junior Assistant. The second and third accused are the President and Vice President of the said Village Panchayat.

5. It is the case of the prosecution that between the years 2011 and 2016, more than sum of Rs.35,00,000/- had been misappropriated by various means. One of the means was for A2 and A3 to issue cheques in the name of this petitioner to A1 and A1 to encash the cheque and receive the amount. There is yet another instant of borewell motors to be purchased and they were stolen and records were burnt. There are several instances which required detailed investigation. The counter has been filed.

6 . Listing out those instances since they are matter of trial and evidence, let me not go any further, but I am satisfied that the custodial interrogation of the petitioner is required. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

7. Accordingly, the Criminal Original Petition seeking anticipatory bail stands dismissed.
