2. Heard the learned counsel for the petitioner.

3. Being satisfied with the reasons stated in the affidavit filed in support of the petition, this petition is allowed and the delay of 254 days in filing the appeal is condoned. It is made clear that in the event, the petitioner succeeds in the appeal, he will not be entitled to any interest for the period of delay.

4. Registry is directed to number the appeal, if the papers are otherwise in order and post on 21.01.2026.
