ORDER

The petitioner, who was arrested and remanded to judicial custody on 04.09.2025, for the offences punishable under Sections 123 of BNS and Section 22(a) of Cigarette and Other Tobacco Products Act, 2003 in Crime No.1028 of 2025, registered on the file of the respondent police, seeks bail. The earlier bail application of the petitioner was dismissed by this Court, vide order dated 16.09.2025 in Crl.O.P.No.25371 of 2025. 2.

The case of the prosecution is that the petitioner was found in possession of 13.200 kilograms of banned tobacco products for the purpose of illegal sales. Hence, this case.

Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side).

Considering the facts, gravity of offence, the earlier bail application of the petitioner in Crl.O.P.No.25971 of 2025 is dismissed only on 16.09.2025 and there is no change of circumstances from thereon, this Court is not inclined to grant bail to the petitioner. 2/4
