Prayer: Writ Petition is filed under Article 226 to issue a Writ of Certiorarified Mandamus, calling for the records relating to the impugned order passed by the 2nd respondent dated 09.11.2024 in RFL/No.2 Joint Sub-Registrar Dharmapuri/160/ 2024 and to quash the same and consequently direct the 2nd respondent to register the partition deed.

O R D E R

The Writ Petition is filed to direct the 2nd respondent to register the document presented by the petitioner for registration without insisting on the production of the original parental document.

2. The grievance of the petitioner is that the partition deed submitted by them has been refused to register by the 2nd respondent for the want of the original parent documents.

3. Heard the learned counsels on the either side and perused the records.

4. In the light of the Judgements passed by this Court in P.Pappu 2/5

Vs. The Sub Registrar and Ramayee - Vs - The Sub Registrar and others, the refusal cannot be sustained.

5. The Writ Petition is allowed. The impugned refusal check slip is quashed. The 2nd respondent is directed to register the document, within a period of 2 weeks from the date of receipt of a copy of this order. No costs.
