ORDER

(Order of the Court was made by the Hon'ble S.M.Subramaniam J.) This miscellaneous petition has been instituted to grant interim injunction restraining the respondents, their men or agent from alienating the petitioner/appellants undivided half share in the petition schedule property pending disposal of the appeal suit.

At the time of institution of appeal suit, the petitioner filed Page No.1 of 3

CMP.No.26739 of 2024 seeking stay of the judgment dated 27.03.2024 passed in OS.No.4361 of 2019 on the file of the learned III Additional Judge, City Civil Court at Chennai. This court dismissed the petition on the ground that the suit for partition instituted by the petitioner has been dismissed and there is no executable decree.

That being the findings in the civil miscellaneous petition seeking stay of the judgment, the present petition seeking interim injunction deserves no merit consideration and consequently, the Civil Miscellaneous Petition stands dismissed.
