: Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue Writ of Mandamus, directing the respondents to disburse the difference of gratuity amount arising out of deputation of service for the period from 14.07.2010 to 20.07.2011 to the petitioner with interest at the rate of 8% per annum from the date of entitlement to till the date of disbursement within a time limit to be stipulated by this Court.

ORDER

The writ petition has been filed for a direction, directing the respondents to disburse the difference of gratuity amount, arising out of deputation of service from 14.07.2010 to 20.07.2011 with applicable interest.

2. The petitioner was appointed as Driver in the respondent Corporation and retired from service on 31.05.2022. While he was in service, he was deputed to Metropolitan Transport Corporation from 14.07.2010 to 20.07.2011. However, while calculating his retirement benefits of gratuity, for the service rendered in Metropolitan Transport Corporation has been left out and remaining amount has been disbursed to the petitioner. On the representation submitted by the petitioner, the deputation gratuity bill for a sum of Rs.22,911/- for the said period has been sanctioned and duly recorded in the Service Register on 11.08.2022. However, it was not disbursed so far. Hence, the petitioner submitted representation.

3. In view of the above, the respondents are directed to disburse the gratuity for the service rendered on his deputation from 14.07.2010 to 20.07.2011 with interest at the rate of 6 % per annum, within a period of 8 weeks from the date of receipt of a copy of this order.
