O R D E R
This writ petition has been filed to forbear the fourth respondent herein, to entertain and register any document relating to the Punja Lands measuring 60 cents (24.5 Ares) comprised in Survey No.5/10A Walajanagaram Village, Ariyalur Taluk and District bearing Patta No.611.

Learned counsel for the petitioner submitted that the property comprised in Old S.No.5/10 and New S.No.5/10A to an extent of 0.24.5 Ares situated at Walajanagaram Village, Ariyalur Taluk and District was belongs to petitioner's maternal grandfather. After his demise, the said property was took possession by the petitioner's maternal grandmother. Subsequently, the petitioner's grandmother under a registered settlement deed dated 15.04.2009 bearing doc.No.762/2009 settled several properties in favour of petitioner and his sister, including the aforesaid property. This being so, one Arjunan falsely claiming right over the
aforesaid property by obtaining forged patta. In this regard, the petitioner's grandmother and mother filed a suit in O.S.No.61/2009 on the file of the District Munsif Court, Ariyalur.

Learned counsel for the petitioner would further submit that by suppressing the material facts, the fifth respondent herein filed W.P.No.4926 of 2011 before this Court, seeking direction to cancel the patta issued in favour of the said Arjunan and issue patta on his favour and in the name of petitioner's grandmother, jointly for the subject matter property situated in S.No.5/10, which was allowed on 07.03.2012. Challenging the same, the petitioner has filed another writ petition in W.P.No.4841 of 2023 and the same is pending. Under these circumstances, the fifth respondent trying to alienate the aforesaid property by having forged patta. Therefore, the petitioner made objection petition before the respondents 1 to 4 on 04.02.2025 and requested the authorities not to entertain any document relating to the aforesaid property for registration, either by the fifth respondent or any person representing the fifth respondent. Hence, the petitioner has come forward with the present writ petition.
4. Per contra, learned Government Advocate appearing for the
respondents would submit that in the present case, the petitioner has filed only a protest petition, which is not in proper format. Hence, this Court may direct the petitioner to file a representation in proper format. In the event any representation is filed, the same will be considered as protest petition and if anyone submits the documents for registering the above said property comprised in S.No.5/10A, due notice will be issued to the petitioner as well as the fifth respondent and thereafter, the matter will be decided on merits and in accordance with law. Hence, he prays for appropriate orders.
5. Heard the learned counsel on either side and perused the materials available on record.
6. In the present case, the petitioner has filed a protest petition dated 04.02.2025, seeking not to entertain any registration in regard to the aforesaid subject property. However, the said petition was not in proper format. Moreover, so far, no document has been filed to register the aforesaid property, hence the official respondents are are not in a position to dispose the protest petition dated 04.02.2025. Such being the case, this Court issues the following directions:
(i) The petitioner is directed to file a representation in proper
format;
(ii) On such receipt, the official respondents are directed to consider the said representation as protest petition and issue notice and opportunity of personal hearing to the petitioner as well as fifth respondent, if anyone submits the documents for registering the aforesaid property comprised in S.No.5/10A and thereafter, pass appropriate orders on merits and in accordance with law.
With the aforesaid directions, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is also closed. 22.10.2025 vm Index: Yes/No Internet: Yes/No Speaking Order/Non-speaking order KRISHNAN RAMASAMY, J.
