O R D E R

This Writ Petition has been filed seeking a direction to the first and second respondent to conduct a time-bound investigation and initiate disciplinary proceedings against the respondents 3 to 5 and to impose a suitable punishment, including the removal of their names from the medical register by considering the petitioner's representations dated 20.07.2025 and 17.09.2025.

2. Heard the learned counsel for the petitioner and learned counsel for the respondents 1 and 2 as well as the learned Government Advocate for the respondents 6 & 7.

The learned counsel for the petitioner submitted that when the petitioner was in abroad, on collusion with the prime accused, the respondents 3 to 5 herein, who are the registered medical practitioners, had issued multiple Life Certificate for the petitioner which were utilized for registration of fraudulent sale deeds and mortgage deed respectively. He further submitted that based on the complaint of the petitioner, a case was filed in Cr.No.18 of 2025 on the file of CCB, Tambaram Commissioner of Police. He submitted that the petitioner also made representations dated 20.07.2025 & 17.09.2025 in this regard to the first and second respondent so as to take disciplinary proceedings against the respondents 3 to 5, since there was has no positive response from the respondents 1 & 2, the present Writ Petition has been filed.

4. Per contra, the learned counsel for the first and second respondent submitted that the respondents 3 to 5 had only issued life certificate to the petitioner, who is alive and hence, there need not be any action against the

respondents 3 to 5.

On the other hand, the learned Government Advocate submitted that the respondents 3 to 5 had issued only life certificate to the alive person i.e., the petitioner herein and based on the complaint lodged by the petitioner in this regard, a case has been registered for the said issue which was pending before the Commissioner of Police, Tambaram in Cr.No.18 of 2025. He further submitted that the investigation will be conducted as per law.

On perusal of the case and taking into consideration of the submissions made by the learned counsel on either side, this Court is not inclined to grant any relief as sought for by the petitioner herein as the case is as against third party and accordingly, the Writ Petition stands dismissed. However, the respondents 1 and 2 shall conduct inquiry based on the representations of the petitioner as against the respondents 3 to 5 and shall proceed as per the guidelines of the Tamil Nadu Medical Council. It is also made clear that the petitioner shall work out his remedy in the manner known to law in respect of the fraudulent deeds.

7. With the above observations and directions, this Writ Petition stands dismissed.
