ORDER

This Criminal Original Petition has been filed by the petitioners, who apprehend arrest, seeking anticipatory bail in Crime No.194 of 2024, registered for the offence under Sections 336(3), 340(2) of BNS. 1/4

2. The case of the prosecution is that the accused had fabricated NRI related documents and affidavits to enable unqualified students to get admission in medical colleges under the NRI quota. Hence, the case.

3. Learned counsel appearing for the petitioner submitted that the petitioners are innocent persons and they have been falsely implicated in this case. He submitted that the petitioners were working under one Boominathan and Vasanth, who have collected money from several students for getting admission under NRI quota. He submitted that the convenor of the admission committee had found that the documents furnished by the candidates were fake and the documents have been cancelled. He also submitted that the petitioners have been implicated only based on the confession of the main accused. He further submitted that the petitioner is ready to co-operate for the investigation and ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for grant of anticipatory bail to the petitioners.

4. Learned Public Prosecutor (Puducherry) appearing for the respondent police, while objecting for grant of bail to the petitioner, submitted that the 2/4

petitioners were working under one Boominathan @ James and that 69 students have been cheated by furnishing fabricated documents. He would submit that the arrested accused are still in the custody and that the investigation is in nascent stage.

5. Heard the learned counsel appearing for the petitioners, the learned Public Prosecutor (Puducherry) for the respondent Police and perused the materials available on record.

6. Taking into consideration that the arrested accused are still in custody and that the investigation is in the nascent stage, this Court is not inclined to grant anticipatory bail to the petitioners.

7. Accordingly, this Criminal Original Petition stands dismissed. 16.12.2024 Anu 3/4
