PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondent to consider and dispose statutory revision preferred by the petitioner in file No.27751 dated 23.05.2024 and pass orders.

ORDER

This Writ Petition has been filed to issue a Writ of Mandamus directing the respondent to consider and dispose statutory revision preferred by the petitioner in file No.27751 dated 23.05.2024 and pass orders.

2.Mr.Abishek Murthy, Government Advocate takes notice for the respondent. In view of the consent expressed by the learned counsel appearing for either side, this petition is taken up for final disposal.

3. The case of the petitioner is that the petitioner is working as Revenue Inspector at Nagapattinam. Whileso a charge memo was issued by the District Collector to the petitioner on 26.08.2015 and enquiry was held and charges were proved and the disciplinary authority imposed the punishment of stoppage of increment for a period of one year with cumulative effect vide proceedings in Rc.10685/2015/A4 dated 20.01.2017. Aggrieved over the same the petitioner preferred an appeal before the Additional Chief Secretary and Commissioner of Revenue Administration who had rejected the appeal vide order dated 06.08.2020 in Se.Mu.Aa.No.Pani 4(4)19380/2017. Challenging the same the petitioner filed W.P.No.1593 of 2022 before this Court and the same is pending, due to which, he preferred a Statutory Revision before the respondent on 23.05.2024 and the same is pending without any progress. Hence, this petition.

4. The learned counsel for the petitioner submitted that it would be suffice if this Court issues a direction to the respondent to dispose of the Statutory Revision preferred by the petitioner and pass orders.

5. The learned Government Advocate appearing for the respondent submitted that they will consider the case of the petitioner and take action in the manner known to law.

6.Considering the facts and circumstances of the case, this Court without expressing any opinion on the merits of the case directs the respondent to dispose the Statutory Revision filed by the petitioner on 23.05.2024 after conducting an enquiry by affording reasonable opportunity of hearing to the petitioner and pass orders within a period of sixteen weeks from the date of receipt of a copy of this Order.

7. With the aforesaid direction, this Writ Petition stands disposed of. No costs.
