Writ Petition filed under Article 226 of the Constitution of India, for issuance of a Writ of Certiorarified Mandamus, to call for the records of the third respondent in his proceedings No.20018/Tha.Ku.3/2023, dated 12.12.2023 and quash the same, and consequently, direct the respondents to grant 30 days leave to the petitioner's husband detenue namely V.Senthil Kumar, Life Convict No.24027, detained at Central Prison, Vellore, without police escort on the basis of petitioner's representation, dated 09.12.2023. ORDER
(Order of the Court was made by M.S.RAMESH, J.) When the matter was taken up for hearing, the learned Additional Public Prosecutor submitted that the petitioner has already availed his eligible ordinary leave fully.
2. Since the petitioner has already availed the eligible ordinary leave
under Rule 22 (1) of the Tamil Nadu Suspension of Sentence Rules, 1982, seeking for further period of ordinary leave is not permissible.
3. In view of the above, the prayer sought for in the present Writ Petition cannot be considered. Hence, the Writ Petition stands dismissed accordingly. No Costs.
