This Writ Petition has been filed to direct the third respondent to consider the representation submitted by the petitioner dated 14.11.2024 and to take necessary action against the respondent No.9 in accordance with Rule 12(2-A)(h) of the Tamil Nadu Minor Minerals Concession Rules, 1959.

The learned counsel appearing for the petitioner submits that the respondent No.9 was given mining license by the third respondent for mining 3000 cubic metres of ordinary sand for construction of Vehicular Underpass at Venkili Village with several conditions. However, contrary to conditions imposed, the respondent No.9 excavated the minerals beyond permitted limit. Aggrieved by the same, the petitioner made a representation on 14.11.2024 against the respondent No.9, however, the same has not been considered. Hence, the present writ petition has been filed.

The learned Additional Government Pleader appearing for the respondents 1 to 6 and 8 submits that pursuant to the representation made by the petitioner on 14.11.2024, the Assistant Director (Mines), Assistant Geologist (Mines) and the Special Revenue Inspector (Mines) inspected the subject lease area on 25.11.2024, however, no violation was found due to quarrying activities started for a short period of interval. Further, the Block Development Officer, Madhanur, was instructed to monitor the subject lease area and to send report if any violation activities are found in the permission granted area.
4. Recording the submission made by the learned Additional Government Pleader appearing for the respondents 1 to 6 and 8, this Writ Petition is closed. If any violation is brought to the notice of the respondent No.7, namely, the Block Development Officer, Madhanur Village, Ambur Taluk, Tirupathur, the respondent No.7 shall take appropriate action and the same shall be forwarded to the third respondent. On receipt of the same, the third respondent may conduct enquiry and pass appropriate orders within a period of two weeks thereafter. Liberty is granted to the
petitioner to make a fresh representation to the respondents, if any violation is found in future.
