The present petition has been filed on account of the inaction on the part of the 1st respondent in not disposing of O.A. No.2/2022 filed by the petitioner u/s 64
(1) of the Tamil Nadu Hindu Religious and Charitable Endowments Act.
2. Mr.S.Ravichandran, Learned Addl. Government Pleader (HR and CE) Department takes notice on behalf of the respondents and has no objection for this Court to dispose of the writ petition.
3. It is the specific case of the petitioner that Kumbabhishegam of Arulmigu Periyandichi Amman shrine is conducted by all communities in the locality and all the communities in the locality perform customary festivals every year. The persons of all communities formed a Trust, viz., Paruthipalli Sri Angalaparameswari Amman Kulaveiva Pangalikal Arakkattalai and registered the Trust vide Doc. No.8/2022 in which the petitioner was appointed as the President. Upon creation of the said Trust, the petitioner filed a representation before the 1st respondent for framing a scheme u/s 64 (1) of the Tamil Nadu Hindu Religious and Charitable Endowments Act, which has been taken on file as O.A. No.2/2022 in which notice was issued for hearing on 15.6.2022, which was rescheduled to Page No:2/4
30.6.2022. However, inspite of lapse of more than three years, no orders have been passed on the said representation and, therefore, left with no option, the present petition has been filed.
4. Learned counsel appearing for the petitioner submits that it would suffice if this Court directs the 1st respondent to consider O.A. No.2/2022 for framing a scheme within a time frame stipulated by this Court.
5. In view of the limited relief sought for, this Court, without going into the merits of the case, directs the 1st respondent to consider O.A. No.2/2022 and pass orders on the same in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.
6. This writ petition is disposed of with the aforesaid observation. There shall be no order as to costs.
