ORDER

This petition has been filed seeking a direction to the 2nd respondent to consider the representation dated 1.09.2025 and forthwith rectify and update the records maintained on the MCA portal in respect of the petitioner company.

2. It is the case of the petitioner that the petitioner is a company and has no insolvency proceedings pending against it. Due to an inadvertent error in the records maintained by the Ministry of Corporate Affairs(MCA), the petitioner is presently shown as being under Corporate insolvency Resolution Process, which is contrary to the true legal position. The genesis of this issue lies in CP. No.1439 of 2018 filed by M/s.Sun Extrusions under Section 9 of the Insolvency and Bankruptcy Code, 2016 before the NCLT, Chennai and the same was dismissed. Thus, there is no insolvency proceedings pending against the petitioner company. Despite this, the MCA portal continues to reflect an active CIRP status against the petitioner. The petitioner made a representation on 01.09.2025 to the respondent enclosing the NCLT dismissal order dated 11.12.2019 requesting rectification of the records in the MCA portal. Despite this, no corrective action has been taken till date. Hence, the present writ petition.

3. The learned counsel for the petitioner submitted that this Court may direct the respondents to consider and pass orders on the petitioners representation within the stipulated time as fixed by this Court.

4. The learned Central Government Counsel appearing for the respondents submitted that the representation will be considered and orders will be passed within the stipulated time as fixed by this Court.

5. Heard the learned counsel for both side and perused the materials available on record.

6. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court directs the second respondent to consider and pass orders on the petitioner's representation dated 01.09.2025 within a period of six weeks from the date of receipt of a copy of this order.
