O R D E R

The present Criminal Original Petition has been filed seeking a direction to the third respondent to conduct further investigation and include all the offence committed by the accused as stated in the complaint in the FIR vide No.214/2025 dated 18.07.2025 and other appropriate legal provisions.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) appearing on behalf of the respondents.

The learned counsel for the petitioner submitted that based on the complaint of the petitioner, originally, FIR was registered against the accused under Sections 296(b), 115(2) and 351(2) of BNS, 2023 as the accused abused the petitioner with filthy language and assaulted him causing grievous injuries and also had threatened to finish him. He contended that the petitioner later came to know that the respondent police had registered the FIR only under Sections 296(b), 115(2) and 351(2) of BNS though there

was repeated threat to the life of the petitioner by the accused. Hence, he prayed this Court to further investigate the matter and to include all other appropriate legal provisions for the offences committed by the accused in the FIR.

The learned Government Advocate on instructions submitted that investigation was completed and a final report has already been filed in this case, which was taken cognizance by the learned Judicial Magistrate-II, Chidambaram on 13.10.2025. He further submitted that the medical examination report also clearly indicates that the petitioner only sustained simple injuries.

5. I have perused the discharge summary and medical examination report which reveals that only abrasion on the left eye and nose and tenderness over the right shoulder, which are only simple injuries. In view of the same, this Court is of the view that no further investigation is required in this matter.

6. Considering the facts and circumstances of the case and the nature of injuries sustained by the petitioner, this Court deems fit to dismiss the petition and accordingly, the Criminal Original Petition stands dismissed. 14.10.2025 DP To 1.The Superintendent of Police, Superintendent of Police office, Manjakkuppam, Cuddalore, Cuddalore District.
