The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the respondents to reconsider and reinstate the petitioner in service or provide compensation for the period of vacancy resulting from the termination and to release the pending service benefits, including pension, Teacher Provident Fund (TPF) and any other dues, with applicable interest. 2.The case of the petitioner is that the petitioner was appointed as a Secondary Grade Teacher in a Government Aided Elementary School located at Manadikuppam on 13.08.1984. The brief facts of the case as stated in the counter affidavit filed by the second respondent is that the petitioner was initially appointed as Secondary Grade Teacher in the third respondent School with effect from 11.11.2002. The petitioner applied for leave on loss of pay from 01.02.2004 to 31.01.2005 and 02.02.2005 to 31.01.2006 and again applied for leave on loss of pay from 02.02.2006 to 31.01.2007. Considering the above facts, the District Elementary Educational 2/4

Officer, Cuddalore vide proceedings dated 27.07.2007 permitted the third respondent to dismiss the petitioner from service with reference to Section 22(1) of Tamil Nadu Recognized Private School Regulation Act, 1973 and Rule 17(1). Accordingly, the third respondent School Committee passed Resolution on 26.09.2007 dismissing the petitioner from service. Hence, the petitioner has filed this writ petition with the above prayer.

3.The learned counsel appearing for the petitioner submitted that this Court may without going into the merits of the case, permit the petitioner to approach the respondents for getting the dismissal order and thereafter to work out the remedy in the manner known to law.

4.Considering the limited relief now sought for by the learned counsel appearing for the petitioner, this writ petition stands disposed of, with liberty to the petitioner to work out the remedy in the manner known to law. No costs.
