This Criminal Original Petition has been filed to quash the final report in C.C.No.271 of 2025 for the offences under Sections 296(b), 115(2), 324(4) and 351(2) of BNS, pending on the file of the Judicial Magistrate-I, Chengam.

The charges against the accused is that on 11.06.2025 at 9.45 a.m., when the defacto complainant was working in the Toll Gate Line-1, the accused persons who were proceeding in a car, tried to flee without paying the toll fee. When the same was questioned by the defacto complainant, the accused abused him with filthy language besides, they attacked him and also damaged his cell phone. In respect of the said occurrence, a counter case is also pending which has been charge sheeted in C.C.No.428 of 2025.

3. The statement of the witnesses clearly implicates the accused persons. The statements are not only with regard to the accused damaging the property namely the cell phone, but also with regard to threatening the defacto complainant and abusing him with filthy language.

4. Therefore, this Court is of the view that it is not a fit case for quashing the final report. Further, the counter case has already been taken cognizance in C.C.No.428 of 2025.

5. Therefore, the trial Court is directed to dispose of both the cases by simultaneous trial.

6. However, the personal appearance of the petitioner before the trial Court is dispensed with except for receipt of copies, answering the charges, questioning under Section 313 Cr.P.C./Section 351 of BNSS and on the date of pronouncing judgment and also on any other dates as may be 2/4

required by the trial Court.
