The petitioner/fifth accused who apprehends arrest at the hands of the respondent police for the offence punishable under Section 8(C), 20(b)(ii)(C) and 25 of NDPS Act 1985 in Crime No.376 of 2023, with respect to the occurrence which took place on 13.04.2023 seeks anticipatory bail.
2. The case of the prosecution is that they stopped ae white colour Fortuner Car bearing Registration No. TN 21 AP 5050 and they were able to inspect the car though it was driven away. Two hundred kgs of Ganja was seized in the back side of the car. The investigation revealed that this petitioner had lent his car to transport Ganja from Andhra Pradesh to Tamilnadu and later the Ganja was transported to the vehicle which had been seized. The petitioner's vehicle had also been seized.
3. It is also stated that the accused Nos. 1 to 4 are still in custody. The learned Government Advocate (Crl. Side) would submit that this petitioner is directly involved in transporting of Ganja from Andhra Pradesh.

4. Taking all the factors into consideration and also the fact that the other accused are still absconding and that the investigation will have to be done about source of the Ganja, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, this Petition stands dismissed.
