PRAYER : Criminal Original Petition filed under Section 482 of Criminal Procedure Code, praying to direct the first respondent to cancel the non traceable certificate in RC.No.224/PUB/CRB/2021 on the file of the 1st respondent dated 04.03.2021 by considering the petitioner's representation dated 14.09.2023.

ORDER

This petition has been filed for a direction to the first respondent to cancel the non traceable certificate that was issued in favour of the third respondent based on the representation made by the petitioner on 14.09.2023, wherein the petitioner has alleged that the third respondent has played fraud and has obtained the non traceable certificate and thereby, he has dealt with the subject property.

2. The learned Government Advocate (Crl. Side) appearing on behalf of the respondents 1 and 2 on instructions submitted that the representation made by the petitioner was enquired and through the proceedings dated 14.11.2023, the representation was rejected by the first respondent. This was also conveyed to the petitioner.

3. The learned counsel for the petitioner submitted that the petitioner has not received any copy of the proceedings dated 14.11.2023 and the petitioner has been kept in dark.

4. Taking into consideration the subsequent development that has taken place, the relief as sought for in this petition cannot be granted by this Court. A copy of the proceedings dated 14.11.2023 shall be served on the learned counsel for the petitioner today. It is left open to the petitioner to work out his remedy in the manner known to law.

5. This Criminal Original Petition is disposed of in the above terms.
