ORDER
This Criminal Original Petition has been filed to direct the Sessions Judge, Mahila Court, Tiruvannamalai to dispose SC.No.133/2019 pending expeditiously within a stipulated time.
2. The case of the petitioner is that in respect of the incident that occurred on 31.03.2015, cases in Crime No.112/2015 and Crime No.155 of 2015 were registered by the respondent Police. The respondent Police has filed a final report as Crime No.112 of 2015 and the same was taken up for trial in S.C.No.133 of 2019 on the file of the Sessions Court, Mahila Court, Tiruvannamalai, whereas in the counter case in Crime No.155 of 2015, the respondents have not filed the filed final report. Meanwhile, the petitioners who are accused in S.C.No.133 of 2019, have come up before this Court seeking for speedy disposal in SC No.133 of 2015.
3. The learned Government Advocate (Crl. Side) appearing for the respondent submitted that the petitioners had earlier approached this Court by filing Crl.O.P.No.24620 of 2021 seeking to quash S.C.No.133 of 2019 and this
Court, by order dated 13.10.2023, had directed the respondent Police to file the final report in Crime No.155 of 2015 within a period of two weeks from the date of receipt of a copy of the order and had directed the Judicial Magistrate, Polur to take final report and commit the case to the Fast Track Mahila Court, Tiruvannamali for simultaneous trial. He further submitted that the final report has been filed very recently and it is not committed to the Court of Session and only after the case is committed to the Court of Session, simultaneous trial could be conducted in both cases.
4. In view of non committal of the case in Crime No.155 of 2015 and the simultaneous trial ordered as stated supra, the prayer sought by the petitioners cannot be considered at this moment. However, a direction is issued to the Judicial Magistrate, Polur to take the final report in Crime No.155 of 2015 on the file of the Polur Police Station, Tiruvannamalai, within a period of two weeks and ensure that the case is committed to the Court of Session at the earliest and the Fast Track Mahila Court, Tiruvannamalai shall conduct simultaneous trial in both the cases.
5. With the above direction, this Criminal Original Petition stands disposed of.
