ORDER

The petitioner, who was arrested and remanded to judicial custody on 23.08.2025 for the alleged offences punishable under Sections 318, 64(2)(h), 49, 296(b), 115(2) and 351(3) of BNS, in Crime No.70 of 2025 on the file of the respondent police, seeks bail.

2. The allegation is that the petitioner/A2 is the friend of A1. The defacto complainant had developed relationship with A1/Delip Kumar, due to which she became pregnant and it was intimated to A1 and he started to harass. On the date of the occurrence, A1 took the defacto complainant to the lonely place and attacked physically and he called A2. The petitioner/A2 and A1 joined together forced the defacto complainant to commit unnatural offence. Hence, the complaint.

3. The learned counsel for the petitioner submitted that since A1 compelled the defacto complainant with A2, a false complaint has been lodged by the defacto complainant and A1 also involved in the sexual assault on the victim girl.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reported that there are two accused in this case, petitioner/A2 and A1. A1 is still absconding and the petitioner is also involved in unnatural sexual offence. The defacto complainant was also pregnant both the accused have forced the defacto complainant to unnatural sexual offence. Hence, he opposed to grant bail to the petitioner.

5. Considering the fact that the petitioner is involved in unnatural sexual assault on the victim, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this Criminal Original Petition stands dismissed. 26.09.2025 dna 3/4
