This criminal original petition has been filed to modify the condition imposed on the petitioner by the Principal District and Sessions Judge, Chengalpattu District in Crl.M.P.No.3493 of 2024 dated 18.11.2024. 2.
Learned counsel appearing for the petitioner submits that the the petitioner was arrested and remanded to judicial custody on 04.10.2024, subsequently, the petitioner has been granted bail by the Principal District and Sessions Judge, Chengalpattu vide order dated 18.11.2024 in Crl.M.P.No.3493 of 2024, with one of the condition that the petitioner is ordered to be released on bail on his execution of bond for Rs.10,000/- each with two sureties (out of which, one surety should be parent of the petitioner). He also submitted that the petitioner's father already died and his mother is aged person, therefore, the petitioner is unable to furnish surety, thereby, the petitioner could not comply with the condition and still in custody, even though, the petitioner was granted bail. Therefore, he prays to modify the condition imposed on the petitioner with respect of furnishing sureties in Crl.M.P.No.3493 of 2024 dated 18.11.2024. 3.
Learned Government Advocate (Crl. Side) appearing for the respondent police submits that the petitioner was arrested and remanded to judicial custody on 04.10.2024, for the offence under Section 296(b), 309(4), 311 2/4
and 351(3) of BNS in Crime No.534 of 2024 on the file of the respondent police. He further submitted that the petitioner has 23 previous cases and offence committed by the petitioner in this case is that, he along with other accused, entered into a textile shop, picked up a quarrel with the shop workers and robbed a sum of Rs.1000/- at knife point, further, threatened the shop workers with dire consequences.

Heard the learned counsel for the petitioners and the learned Government Advocate (Crl. Side) appearing for the respondent police and further taking note of the fact that this present petition seeking modification has been filed before this Court, without approaching for modification before the concerned Court, which had already granted bail to the petitioner. 5.
In view of the above, this criminal original petition is dismissed with a liberty to the petitioner, to file modification petition before the Court concerned.
