Apprehending arrest in connection with Crime No.608 of 2024 registered for the offences punishable under Sections 8(c), 20(b)(ii) and 29(1) of NDPS Act, the present petition has been filed seeking anticipatory bail. 2.The case of the prosecution is that on 05.10.2024, at about 11.00 1/4

A.M., the respondent Police got information from their informer that Ganja was sold by the 1st accused and the petitioner. When the Police officials came to the place of occurrence, the petitioner herein escaped from the scene of occurrence and the Police arrested the 1st accused and seized 1 Kilo 100 grams of Ganja from the 1st accused. Thus, the petitioner committed the alleged offence of sale of Ganja along with the 1st accused.

3.The learned counsel for the petitioner would submit that the petitioner is innocent. He would further submit that the petitioner is studying B.Sc Microbiology in Coimbatore and his native is Mayiladuthurai which clearly shows that the petitioner has been falsely implicated in the present case based on the confession recorded from the other accused.

4.The learned Government Advocate (Crl. side) would submit that the petitioner, who claims to be a student had repeatedly involved in selling of Ganja and he has got two previous cases apart from this case registered for the offence committed under NDPS Act.

5.Heard the learned counsel for the petitioner as well as the learned 2/4

Government Advocate (Crl. side) and perused the materials available on record. 6.Taking into consideration the above submissions and the fact that the petitioner is a habitual offender and he has two previous cases registered under NDPS Act, this Court is not inclined to grant Anticipatory Bail. 7.Accordingly, this Criminal Original Petition is dismissed. 19.12.2024 rst To 1.The Judicial Magistrate-II, Coimbatore.
