For Petitioner : Mr.A.Neeraj For R1 to R4 : Mr.D.Ravichander Special Government Pleader O RDER This Writ Petition has been filed for direction directing the second respondent to cancel the patta bearing Patta No.689 issued in favour of the fifth respondent in respect of the land comprised in Dry Survey No.79/4B and now sub-divided as 79/5 ad-measuring 0.20 acre situated at Jabrapet Village, Katpadi Taluk, Vellore District.

2. Heard the learned counsel for the petitioner and the learned Special Government Pleader for the respondents 1 to 4 and perused the materials available on record.

3. The petitioner submitted a representation before the first respondent and the same was forwarded to the Revenue Divisional Officer and it is pending before the Revenue Divisional Officer, Vellore. Therefore, the second

respondent is not a valid authority to cancel the patta issued in favour of the fifth respondent.

4. In view of the above, the Revenue Divisional Officer, Vellore is directed to conduct enquiry on the representation submitted by the petitioner for cancellation of patta bearing Patta No.689 issued in favour of the fifth respondent in respect of the land comprised in Dry Survey No.79/4B and now sub-divided as 79/5 ad-measuring 0.20 acre situated at Jabrapet Village, Katpadi Taluk, Vellore District, after issuance of notice to the petitioner and the fifth respondent herein and dispose of the same, on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above directions, this writ petition stands disposed of. No costs.
