ORDER
The petitioner has filed the present writ petition seeking a direction to the respondents to implement the orders passed by the 1st respondent in G.O.Ms.Nos.159, 160 and 161 dated 07.07.2015, whereby the 1st respondent confirmed the orders passed by the 2nd respondent in Rc.Nos.94 and 95 of 2011 dated 20.04.2012.

The petitioner (Party-in-person) appeared before this Court and submitted that the 1st respondent vide Government Orders Nos.159, 160 and 161 dated 07.07.2015, had confirmed the orders passed by the 2nd respondent. However, according to the petitioner, despite the issuance of the said Government Orders, the 1st respondent has not taken steps to implement the same. In such circumstances, the petitioner has approached this Court seeking appropriate directions for implementation of the said Government Orders.
3. Per contra, the learned counsel appearing for the respective respondents including the newly impleaded respondents submitted that the 3/8
very same Government Orders viz., G.O.Ms.Nos.159, 160 and 161 dated 07.07.2015, were challenged by certain aggrieved persons by filing writ petitions in W.P.Nos.9113 and 9114 of 2016 before this Court. The said writ petitions came to be disposed of by this Court by order dated 19.08.2025. Aggrieved by the said order, the parties concerned have preferred writ appeals in W.A.Nos.3025 and 3026 of 2025, which are presently pending before the Hon'ble Division Bench of this Court. It is therefore submitted that since the matter is presently seized of by the Hon'ble Division Bench, the prayer sought for in the present writ petition has become infructuous. Therefore, this Court may dispose of this writ petition by issuing appropriate directions in the above regard.

In response, the petitioner, appearing as party-in-person, submitted that as on date there is no restraint order or interim order passed by the Hon'ble Division Bench staying the operation of the Government Orders. According to the petitioner, in the absence of any such restraint order, it is the duty cast upon the 1st respondent to implement the Government Orders in G.O.Ms.Nos.159, 160 and 161 dated 07.07.2015, and in the light of the above, appropriate directions may be issued by this Court.
5. This Court has considered the submissions made by learned counsel on either side and perused the materials placed on record. 4/8
6. It is not in dispute that the 1st respondent had issued G.O.Ms.Nos.159, 160 and 161 dated 07.07.2015 confirming the orders passed by the 2nd respondent in Rp.Nos.94 and 95 of 2011dated 20.04.2012. It is also brought to the notice of this Court that the said Government Orders were challenged before this Court in W.P.Nos.9113 and 9114 of 2016, which came to be disposed of by order dated 19.08.2025, and that writ appeals in W.A.Nos.3025 and 3026 of 2025 are pending before the Division Bench.
7. In such view of the matter, this Court is of the considered opinion that the 1st respondent shall verify whether any interim order or restraint order has been granted by the Hon'ble Division Bench in the aforesaid writ appeals restraining the implementation of the Government Orders.

Accordingly, the 1st respondent is directed to verify whether any restraint order has been obtained by the aggrieved persons in respect of G.O.Ms.Nos.159, 160 and 161 dated 07.07.2015 and the order passed by this Court in W.P.Nos.9113 and 9114 of 2016 dated 19.08.2025. In the event there is no restraint order operating against the implementation of the said Government Orders, the 1st respondent shall take appropriate steps to implement the same in accordance with law within a period of six weeks from the date of receipt of a copy of this order.

9. With the above directions, the writ petition is disposed of. No costs. Consequently, connected miscellaneous petitions are closed. 11.03.2026 Note : Registry is directed to issue order copy after carrying out necessary amendment.
