..Respondent(s) PRAYER: This Criminal Miscellaneous petition has been filed under Sections 452 and 528 o B.N.S.S. to cancel the bail granted to the 2nd Respondent/Petitioner/Accused herein in Crl.O.P.No.26778 of 2024, dated 30.10.2024 in the above Crime No.348 of 2024 on the file of the 1st Respondent.

ORDER

The present Criminal Miscellaneous petition has been filed to cancel the bail granted by this Court vide order dated 30.10.2024.

2. The only allegation against the 2nd respondent / accused is that the 2nd respondent is not co-operating with the investigation. The said contention of the petitioner is not supported by the learned Government Advocate (Criminal side) appearing for the 1st respondent police and he would submit that the petitioner has appeared before the respondent police from 14.11.2024 to 07.01.2025.

3. Therefore, taking into consideration of the submissions made by the learned Government Advocate, this Court is of the view that no ground is made out to cancel the bail, as the cancellation of the bail, is serious in nature, as the same would curtail the bail of an individual granted by this Court. Unless there are strong case is made out, the question of interfering with the bail granted by this Court, is to be discouraged.

4. Accordingly, the Criminal Miscellaneous Petition is dismissed. 02-04-2026 MJS
