O R D E R

The petitioner, who was arrested and remanded to judicial custody on 02.08.2025, for the offence punishable under Section 6 of POCSO Act, in Crime No.188 of 2025, on the file of the respondent Police, seeks bail.

2. The case of the prosecution is that the victim and the petitioner were friends, and on 22.07.2025, the petitioner called the victim to his loan office, where he allegedly committed aggravated penetrative sexual assault on her. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and has been falsely implicated in this case . He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent police submitted that, under the guise of a promise to marry, the petitioner had committed aggravated penetrative sexual assault on the victim girl, and that the investigation in the case is still in progress. 2/4

Considering the fact that the allegations against the petitioner are of a serious nature, and that the petitioner, aged about 28 years, is alleged to have committed aggravated penetrative sexual assault on the victim girl aged about 15 years, and since the investigation in the case is still pending, this Court is not inclined to grant bail to the petitioner.
