The petitioner was arrested on 23.07.2025, on execution of NonBailable Warrant issued by the learned Court of Sessions, Magalir Needhi Mandram (Fast Track Mahila Court), Tiruppur, for the offence punishable under Sections 294(b), 342, 34, 302, 307 and 506(ii) of IPC pending trial in S.C.No.44 of 2021 in respect of Crime No.878 of 2019 on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that he was involved in a case of murder and was subsequently granted bail. After the case was committed to the Court of Sessions in S.C.No.44 of 2021 on the file of the learned Court of Sessions, Magalir Needhi Mandram (Fast Track Mahila Court), Tiruppur, the petitioner remained absconding during the trial stage from 07.11.2022 to 11.07.2025. Hence, Non-Bailable Warrant (NBW) was issued. Thereafter, the petitioner was arrested and remanded to judicial custody on 23.07.2025.

3. Today, 26.09.2025, when the matter was taken up for hearing, there was no representation on behalf of the petitioner. 2/5

Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that two bail petitions filed by the petitioner were dismissed by the Trial Court in Crl.M.P.Nos.304 and 330 of 2025 by orders dated 12.08.2025 and 26.08.2025 respectively. He further submitted that the case is now pending for trial.

5. Heard both sides and perused the materials available on record.

6. Considering the facts and circumstances of the case, and taking into account that the petitioner had remained absconding for nearly three years (from 07.11.2022 to 11.07.2025) and that the trial date is now likely to be fixed, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, this criminal original petition stands dismissed. 26.09.2025 cda 3/5
