PRAYER: Civil Revision Petition is filed under Article 227 of the Constitution of India, for a direction to the learned Principal District Munsif at Alandur to dispose of O.S.No.51 of 2008, pending on its file, in a speedy manner, within a time fixed by this Court. O R D E R

The civil revision petition seeks for expeditious disposal of O.S.No.51 of 2008 on the file of the learned Principal District Munsif at Alandur.

2. When the matter came up for admission on 02.01.2025, I called for a report from the learned Principal District Munsif at Alandur to state as to how long she requires to dispose of O.S.No.51 of 2008.

3. The learned Principal District Munsif at Alandur has sent a report stating that I.A.No.401 of 2014 has been presented under Section 45 of the Indian Evidence Act read with Order XXVI Rule 9 of the C.P.C. That application is pending. During the pendency of the said I.A., 3rd defendant died on 01.02.2018 and his legal heirs were impleaded only on 19.07.2024. No petition has been filed to implead the legal heirs of the 2/4

3rd defendant in I.A.No.401 of 2014. For the said purpose, I.A.No.401 of 2014 has been adjourned time and again. The report further states that now the suit has been posted on 21.01.2025 along with I.A.No.401 of 2014 for filing steps by the plaintiffs. Therefore, she requests three months time to dispose of the said suit.

4. Taking into consideration the report of the learned Trial Judge, there shall be a direction to the learned Principal District Munsif at Alandur to dispose of O.S.No.51 of 2008 within a period of four months from the date of receipt of a copy of this order.
