ORDER

The petitioner, who was arrested and remanded to judicial custody on 14.09.2025, for the offences punishable under Sections 123 and 275 of BNS and Section 24(1) of COTPA Act in Crime No.389 of 2025, registered on the file of the respondent police, seeks bail. 2.

The case of the prosecution is that on 14.09.2025, while the respondent police were on their routine patrol duty, they found that the petitioner was involved in illegal transportation of 205.900 kilograms of banned tobacco products. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner was falsely implicated in this case and he is in judicial custody since 14.09.2025 and the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the 2/4

prosecution case and states that huge quantity of contraband involved in this case; and that the investigation is pending. 5.

Considering the facts, gravity of offence, huge quantity of contraband involved in this case and the fact that the investigation of this case is pending, this Court is not inclined to grant bail to the petitioner. 6.

Accordingly, this criminal original petition stands dismissed. 26.09.2025 stn To
