ORDER

The petitioner, who was arrested and remanded to judicial custody on 24.06.2025 for the alleged offences punishable under Sections 126(2), 296(b) and 103(1) of BNS Act, in Crime No.179 of 2025 on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that the petitioner is ranked as A7, who had illegal relationship with A1. It is alleged that A1 had previous enmity with the deceased in this case for the reason that the deceased was the root cause for separation of A1's wife and was also a cause for the trouble in the matrimonial life. A1 conspired with A7 & A5 and A7 paid a sum of Rs.20 lakhs to A5 for the purpose of murdering the deceased. Accordingly, A5 engaged A4 and A1, A2 to A4 went to the place of occurrence, waylaid the deceased and attacked him with deadly weapons and caused his murder. Subsequent to the arrest of A1 be revealed that the petitioner has contributed a sum of Rs.20 lakhs for committing murder of the deceased in this case. Hence, the case.

3. The learned counsel appearing for the petitioner submitted that the petitioner is a lady and she is in custody and further submitted that the petitioner has been falsely implicated in this case. Hence, he prayed for grant of bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent police reported that there was illegal affair between the petitioner/A7 and A1 and they planned to commit murder of the deceased. He further submitted that earlier bail application was dismissed by this Court in Crl.O.P.No.24608 of 2025 on 10.09.2025, while the case was pending for investigation. Now the final report also filed in PRC.No.47 of 2025. Hence, he opposed to grant bail to the petitioner.

5. Heard both sides and perused the materials available on record.

6. Considering the fact that the petitioner is a lady and allegation against her is that, she has contributed money to the A1 for the purpose of murdering the deceased and she had not participated in attacking the 3/6

deceased, also the fact that final report filed in PRC.No.47 of 2025, this Court is inclined to grant bail to the petitioner with certain conditions.

Accordingly, the petitioner is ordered to be released on bail on her executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand Only) with two sureties, for a like sum to the satisfaction of the learned Judicial Magistrate, Sholingar and on further conditions that: [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the0 identity proofs to ensure their identity;

[b] the petitioner shall report before the concerned Court daily at 10.30 a.m., for a period of four weeks and thereafter, on all hearing dates; [c] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioner in 4/6

accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court herself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];

[d] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S. 07.10.2025 dna Note :
