ORDER

The petitioner has filed this petition seeking to provide police protection to conduct festival in the Temple.

2. On perusal of records, it is seen that the petitioner has filed several Writ Petitions before this Court for similar prayer. One such writ petition is WP.No.19114 of 2024, which was disposed of by this Court and another writ petition filed by the petitioner in WP.No.32474 of 2024 was dismissed. The petitioner again filed another writ petition in WP.No.3201 of 2025, which was dismissed by this Court observing that entertaining prayers on caste basis in exercise of the jurisdiction under Article 226 of the Constitution of India is not permissible. The same was challenged by way of filing W.A.No.1007 of 2025, wherein the appellate Court permitted to conduct enquiry independently by Revenue Divisional Officer (RDO). However, the petitioner once again filed

WP.Crl.No.302 of 2025 seeking police protection to conduct festival and the same was allowed.

3. From the above, it is seen that the petitioner one way or another has filed several petitions before this Court. The issue pertains to the rights of the parties to conduct festival and in the Writ Appeal, this Court has already permitted to conduct RDO enquiry. In such view of the matter, let the parties shall appear before the first respondent/RDO and after enquiry, the RDO shall take a decision. If the parties agreeable for such decision, they shall conduct the festival harmoniously. If the parties are not wiling to accept the decision of RDO, festival itself shall be conducted by the Tahsildar and not by the parties.

4. With the above direction, this petition is disposed of. No costs. 07-10-2025 pvs Index:Yes/No Speaking/Non-speaking order Internet:Yes
