O R D E R

(Order of the Court was made by P.VELMURUGAN, J.) This Habeas Corpus Petition has been filed to direct the respondents to secure and produce the detenue Vinayagamoorthy S/o.Subramanian before this Court from illegal confinement and commit him in accordance with law to undergo the sentence imposed on him.

2. Heard both sides and perused the materials available on record.

3. The learned Additional Public Prosecutor submitted that the detenu who is a convict prisoner, while undergoing sentence of imprisonment, under the guise of heart problem, admitted in the hospital. At that time, the detenu absconded from the hospital and departmental proceedings has also been initiated against the staff concerned. He further submitted that the petitioner is not co-operating for the enquiry for the reason that this Habeas Corpus Petition is pending and that she is having communication with the

detenu. In order to escape from the clutches of law and from undergoing the period of sentence, the detenu is absconding.

4. This Court finds that there is no illegal detention and it is a case of absconding. Hence, this Court is not inclined to entertain this petition.

5. Accordingly, this Habeas Corpus Petition is dismissed.

6. However, the petitioner is at liberty to work out her remedy in the manner known to law.
