O R D E R
This Writ Petition has been filed challenging the order passed by the first respondent vide R.C.No.E3(1)/01/165/2025, dated 30.04.2025 and for a consequential direction to the first respondent to renew the license of the petitioner's premises at New No.151, Old No.79, General Patters Road, Anna Salai, Chennai - 600 002.
2. According to the petitioner, he is running a hotel under the name 2/6
and style of ''SHURUDHI PALACE'' and has been conducting Indian cultural dance from 1993. The first respondent has granted 'Public Resort Licence' for conducting the cultural programme under Sections 34 and 36 of the Chennai City Police Act, 1888, to the petitioner. Thereafter, the said licence was renewed periodically. As such, the petitioner has applied for renewal of the said license on 30.10.2024. Instead of renewal, the first respondent issued a show cause notice dated 30.04.2025. Thereafter, the petitioner has sent an explanation by way of objections to the first respondent on 19.05.2025 by requesting them to renew the said licence.
3. The grievance of the petitioner is that though he has given reply to the show cause notice on 19.05.2025, the same has not been considered by the first respondent. Hence, the present petition is filed challenging the very same impugned show cause notice.
4. Heard the learned counsel on either side and perused the materials available on record.
5. At the outset, as a matter of fact, there shall be a direction to the petitioner to submit his explanation and upon such explanation being submitted forthwith, the first respondent-Police shall consider and pass 3/6
orders on merits and in accordance with law within a period of one month from the date of receipt of the petitioner's explanation.
6. With the above directions, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petitions are closed.
