ORDER
Seeking a direction to the respondents to consider the third petitioners' online application dated 15.3.2023 for transfer of patta in the names of the petitioners in respect of the properties measuring Acre 16.33 cents in S.F.Nos.391/1, 391/3, 392/1, 392/3, 395, 396, 397/1, 397/3, 415, 416, 306, 307, 309, 310, 295/2, 280/1, 279/2, 279/3, 278/2 and 277/4 in Kallipalayam Village of Annur Taluk, Coimbatore District, the petitioners are before this Court.
2. Heard the learned counsel for the petitioners and the learned Additional Government Pleader accepting notice for the respondents.
3. The affidavit is sworn to by the first petitioner wherein she stated that the subject properties belonged to their grandfather - one Mr.Krishna Goundan. He acquired them pursuant to a partition deed dated 22.8.1920 registered as doc.No.1596 of 1920 on the file of the Sub-Registrar, Periyanaickenpalayam. The said Mr.Krishna Goundan 2/4
and his wife - one Mrs.Kuzhandaiyammal died respectively on 10.12.1927 and 26.10.1947. Subsequently, the two sons of the said Mr.Krishna Goundan also died. The petitioners are the only surviving legal heirs of the said Mr.Krishna Goundan succeeding to his estate. Hence, the petitioners made several online applications to the second respondent seeking name transfer in the patta by paying necessary charges. One such online application is dated 15.3.2023. But, no action has been taken on the same. Therefore, the petitioners have come forward with this writ petition.
4. It is more than 1 1/2 years since the said online application has been made. The second respondent is keeping it pending without passing any orders on the same.
5. Considering the limited nature of the relief sought and without expressing any opinion on the merits, the writ petition is allowed and a Mandamus is issued to the second respondent to consider the said online application of the third petitioner dated 15.3.2023 for name transfer in the patta on merits and pass appropriate orders in accordance with law within a period of four weeks from the date of receipt of a copy of this order. No costs.
