Respondent / Defendant - - - - - As directed by this Court in its earlier order dated 08.01.2025, the bailiff's report has been placed on record by the Registry. As seen from the same, the Master of the defendant Vessel has been duly served with the warrant of arrest on 11.12.2014 and all the port authorities disclosed in the warrant of arrest have also been served.

2. The learned counsel for the applicant / plaintiff submits that the applicant / plaintiff will be filing an application seeking for sale of the 1/3

Vessel as per the provisions of the Madras High Court Admiralty rules.

3. A. No.6481 of 2024 was filed along with the plaint by the applicant / plaintiff under Order 2 Rule 2, CPC seeking leave of this Court to file further claims against the respondent / defendant. Since the respondent / defendant has not entered appearance till date, despite service of notice on 11.12.2024 itself, this Court after giving due consideration to the contents of the affidavit filed in support of A. No.6481 of 2024 is of the considered view that sufficient cause has been shown by the applicant / plaintiff for seeking further reliefs as prayed for in A. No.6481 of 2024. Therefore A. No.6481 of 2024 filed under Order 2 Rule 2, CPC is allowed as prayed for.

Post the matter on 26.02.2025.
