ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offence under Section 303(2) & 326(a) of BNS Act, 2023 in Crime No.60 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The allegation against the petitioner is that the respondent police was 1/4

on regular patrol was found that the petitioner was illegally transported 1/4 unit of river sand in bullock cart without any valid licence. Hence the case.

2. The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner.

3. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and reported that investigation in this case is pending and he has no previous bad antecedents registered. However, he oppose to grant anticipatory bail to the petitioner.

4. Considering the above facts and circumstances of the case, the nature of allegation and the fact that investigation of this case is pending, and also the fact that the petitioner has illegally transported river which causing damage to the ecology and water body, this Court is not inclined to grant anticipatory bail to the petitioner.

5. Accordingly, this Criminal Original Petition stands dismissed. 06.10.2025 ssi 2/4
