ORDER
This petition has been filed to modify the conditions imposed in Crl.O.P.No.29487 of 2024 dated 05.12.2024 in Para 4 of the order that the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.15,000/- and with two sureties (Out of the two sureties one should be either Mother or Father of the Petitioner) each for a like sum to the satisfaction of the II Additional Sessions Judge, Puducherry.
2. Learned Counsel for the Petitioner submits that this Court while granting bail to the petitioner directed the petitioner that he should execute a bond for a sum
of Rs.15,000/- with two sureties, out of the two sureties, one should be either mother or father of the petitioner. He submits that the father of the petitioner is no more and the mother of the petitioner is presently residing in Muscat and thereby, he is unable to comply with the condition. Hence, he seeks for modification of condition. He would further submit that his wife is ready to stand as a surety to him.
3. Considering the facts and circumstances of the case and also the submissions made by the learned counsel for the petitioner, the condition imposed on the petitioner is modified to the effect that the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.15,000/- with two sureties, (one should be the spouse of the petitioner), each for a like sum to the satisfaction of the II Additional Sessions Judge, Puducherry. All other conditions remain unaltered.
4. With the above directions, the Criminal miscellaneous Petition is ordered. 13-12-2024 shl Note: Issue order copy by 16.12.2024
