Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 4th Respondent to register the Gift Deed transferring 0.88 Cents of land (Survey No. 65/2B) and 0.42 Cents of lands (Survey No. 65/2C), totally 1 acre 30 cents of land situated at Narumanam Village, Virudhachalam Taluk, Cuddalore District to the petitioner's wife, Arogya Mary, accepting the certified copies of the original earlier documents.

ORDER

The Writ Petition is filed seeking a mandamus to direct the 4th Respondent to register the Gift Deed transferring 0.88 Cents of land (Survey No. 65/2B) and 0.42 Cents of lands (Survey No. 65/2C), totalling 1 acre 30 cents of land situated at Narumanam Village, Virudhachalam Taluk, Cuddalore District to the petitioner's wife, Arogya Mary based on the certified copies of the earlier documents.

2. Though a certified copy of the earlier document has been presented, the 2/5

Sub Registrar has refused to register the Gift Deed and to issue a refusal check slip. Hence, the petitioner is before this Court.

3. In the light of the Judgement passed by this Court in Ramayee - Vs - The Sub Registrar and others - (2020 (6) CTC 697), the gift deed is liable to be registered.

4. The Writ Petition is allowed. The 4th respondent is directed to register the Gift Deed dated 14.11.2024, within a period of 2 weeks from the date of receipt of the representation of the document. No costs. 02.01.2025 Index: Yes/No Speaking order/non-speaking order srn To,
