Prayer: Criminal Original Petition is filed under Section 528 of the BNSS, to direct the respondent to complete the investigation and submit the final report in respect of the Crime No.458 of 2023 pending on the file of the Inspector of Police, M3, Puzhal Police Station, Chennai, within any stipulated period of time.

O R D E R

This Criminal Original Petition is filed by the petitioner seeking direction to the respondent to expedite the investigation in Crime No.458 of 2023 and to file final report.

2. Mr.S.Sugendran, the learned Additional Public Prosecutor appearing for the State, on instructions would submit that negative final report was already filed on 29.06.2024 before the District Munsif-cumJudicial Magistrate, Mathavaram, and notice was also sent to the petitioner informing about the final report.

3. The learned counsel for the petitioner would submit that he is unable to file Protest Petition before the Magistrate, because the Magistrate has already returned the final report filed by the respondent.

4. In view of the above facts and circumstances, direction is issued to the respondent to rectify the defects and to file the final report at the earliest.

5. It is open to the petitioner thereafter to file Protest Petition in accordance with law.

6. With the above directions, this Criminal Original Petition is closed.
