C.M.P.No.28380 of 2025 in CMA. SR. No.141678 of 2025 C.V.KARTHIKEYAN, J.

AND K.RAJASEKAR, J.

This petition has been filed seeking to condone the delay of 634 days in preferring the appeal against the award in MCOP No.4107 of 2023 dated 07.09.2023 on the file of the Motor Accident Claims Tribunal, Special Sub Court - II, Chennai.

2.In the affidavit filed in support of the petition, it had been stated that the award was sent to the appellant company by the lower Court belatedly and due to administration reasons there has been delay in filing the appeal. 3.Notice had been directed in this petition. The learned counsel for R1 and R2 had taken notice. The 3rd respondent had remained ex parte before the trial Court and his presence dispensed with in the present petition. 4.Taking all the factors into consideration, the delay is condoned. Accordingly, this petition stands allowed. The Registry may number the appeal, if it is otherwise in order and list the same in the usual course. (C.V.K., J.)
