O R D E R

Challenge has been made against the issuance of Non Bailable Warrant in the Execution Petition filed for recovery amount Ordered by the Family Court in the present Civil Revision Petition.

2. The respondent has filed an application seeking interim maintenance and filed Execution Petition for recovery of the maintenance amount. As the amount has not been filed, it appears that Non Bailable Warrant has been issued against the petitioner.

3. The learned counsel appearing for the petitioner would submit that the petitioner is ready to pay the amount Ordered by the Family Court in instalments.

4. The total amount payable by the petitioner is Rs.4,78,000/- and the petitioner is ready to pay the said amount in instalments. In such view of the matter, let the executing Court consider recalling the non bailable warrant Page 2 / 4

issued against the petitioner subject to the condition that the petitioner shall pay a sum of Rs.1,00,000/- [Rupees one lakh only] within a period of three weeks from the date of receipt of a copy of this Order. On such payment, the executing Court may recall the warrant and provide some time to the petitioner to pay the remaining amount.
