ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.The case in STC.No.1474 of 2017 was taken on the file of the Judicial Magistrate Court, Udhagamandalam Taluk, Nilgiris, for the alleged offence under Sections 151 of Code of Civil Procedure, 1973 and Section 7(1)(a) of Criminal Law Amendment Act, 2005 The allegation in this case is that the accused was found to be in a public place and threatening the common public people and for the same, the case is pending from the year Page No.1 of 3

2017. There is no previous or subsequent case pending against the accused. 3.Considering the factual matrix, context of the case, the reason for absence from his usual place, and the submission that, despite best efforts, warrant could not be executed, it is evident that even if the accused is brought to face trial, it would impinge upon his right to a speedy trial. Due to the passage of time, a meaningful trial is unlikely, and no useful purpose would be served.

4.Accordingly, the case in STC.No.1474 of 2017 of Judicial Magistrate Court, Udhagamandalam Taluk, Nilgiris, stands quashed. This Suo Motu Transfer Case is disposed of.
