ORDER
This Writ Petition has been filed seeking a direction to the fourth respondent to issue patta in respect of the land comprised in Survey No.275/1, to an extent of 30 cents, situated at Nagarpalayam Village, Namakkal District.
2. Heard the learned counsel appearing on either side and perused the materials available on record.
3. Admittedly, the land comprised in Survey No.275/1, measuring 30 cents, situated at Nagarpalayam Village, Namakkal District, is classified as Natham land and is vacant. Though the petitioner obtained a decree for permanent injunction in respect of the subject property in O.S.No.334 of 2008 on the file of the Additional District Munsif Court, Tiruchengode, against the respondents, the petitioner is not
entitled to patta for the Natham land merely because of such decree. If the petitioner has constructed any house for residential purposes on the said land, he would be entitled to patta only for the constructed portion.
4. In view of the above, the application submitted by the petitioner seeking patta for the vacant land, that too, measuring 30 cents, cannot be considered. Thus, the writ petition lacks merits and is liable to be dismissed. Accordingly, this Writ Petition stands dismissed.
