ORDER

This Criminal Miscellaneous Petition has been filed seeking cancellation of the anticipatory bail granted to the first respondent by this Court in Crl.O.P.No.8637 of 2024 dated 18.04.2024.

2. The learned counsel for the petitioner submitted that the petitioner is the de facto complainant in Crime No.186 of 2023. The present Criminal Miscellaneous Petition has been filed on the ground that the conditions imposed by this Court in Crl.O.P.No.8601 of 2024 dated 17.04.2024 have not been complied with and, therefore seeks cancellation of the anticipatory bail granted to the first respondent in Crl.O.P.No.8637 of 2024.

Per contra, the learned counsel appearing for the first respondent submitted that Crl.O.P.No.8601 of 2024 relates to Crime No.14 of 2024, whereas Crl.O.P.No.8637 of 2024 relates to Crime No.186 of 2023. Therefore, both relate to different crime numbers and the conditions imposed in Crl.O.P.No.8601 of 2024 cannot be made applicable to Crime No.186 of 2023. He further submitted that, pursuant to the order passed by this Court in Crl.O.P.No.8637 of 2024 dated 18.04.2024, the first respondent has deposited a sum of Rs.3,00,000/- to the credit of Crime No.186 of 2023, which fact has not been seriously disputed by the learned counsel for the petitioner. __________Page 2 of 4

In such circumstances, this Court is of the firm view that the very basis for seeking cancellation of anticipatory bail is misconceived, since the alleged violation pertains to the conditions imposed in another anticipatory bail order relating to different crime number. The first respondent has also complied with the condition imposed in Crl.O.P.No.8637 of 2024 by depositing a sum of Rs.3,00,000/- to the credit of Crime No.186 of 2023. Therefore, this Court is unable to find any valid ground to cancel the anticipatory bail granted to the first respondent.
