For Petitioner(s):

Mr.Sunny Sheen for Mr.K.Karthikeyan

COMMON ORDER The petitioner has filed these petitions challenging the order dismissing the applications filed to recall PW1 under Section 348 of BNSS.

2. The Trial Court taking note of the fact that PW1 was already cross-examined as early as on 14.02.20214, dismissed the said applications.

3. It is relevant to note that in an earlier occasion, the petitioner challenged the order dismissing the petition filed under Section 91 Cr.P.C. in Crl.O.P.Nos.24829 and 24835 of 2025. This Court while confirming the orders of the Trial Court held that if the petitioner really wants to examine any person, he can very well summon that person, who has custody of the documents, to prove his contents as defence witness. Since this Court already granted permission to the petitioner to summon the concerned officials, who have the custody of the documents available, it is for the petitioner to examine those officials by taking summons and prove his defence.

4. With the above direction, these petitions are dismissed. Consequently, connected miscellaneous petitions are closed. 09-10-2025 pvs Index:Yes/No Speaking/Non-speaking order Internet:Yes
