2. On an earlier occasion, the petitioners had also filed C.M.P.No.687 of 2025 in S.A.No.875 of 2010 and C.M.P.No.2162 of 2025 in S.A.No.876 of 2010 to condone the delay in filing the application to set aside the abatement.
3. A learned Single Judge of this Court, who took up both the petitions, by order dated 30.04.2025, had stated that if costs of Rs.3,000/- are paid to the Tamil Nadu Legal Services Authority on or before 09.06.2025, the delay would be condoned.
4. The learned counsel for the petitioner has produced the proof for payment of costs, which had been paid on 09.06.2025. The delay therefore stands condoned and the said applications namely C.M.P.Nos.687 of 2025 and 2162 of 2025 are both allowed.
5. Consequent to that, these applications, which are to set aside the abatement and to bring on record the Legal Representatives of the appellant as further appellants 2 and 3 are also allowed. 2/4
6. Registry to carryout necessary amendments in the cause title in both the appeals, noting the death of the sole appellant and bringing on record his Legal Representatives, R.Paruvatham and R.Chandrasekaran as appellants 2 and 3. No costs.
