The petitioner was arrested on 28.05.2025, on execution of NonBailable Warrant issued by the learned Additional District and Sessions Judge, Attur, for the offence punishable under Sections 397 of IPC @ 120(b) r/w 397 of IPC pending trial in S.C.No.210 of 2025 in respect of Crime No.371 of 2005 on the file of the respondent police, seeks bail.
2. The allegation against the petitioner is that he was involved in a case of robbery. After the case was posted for committal to the Court of Sessions in S.C.No.210 of 2025 on the file of the learned Additional District and Sessions Judge, Attur, the trial has been commenced, and the petitioner remained abscond for more than 7 years. Hence, Non-Bailable Warrant (NBW) was issued. Thereafter, the petitioner was arrested and remanded to judicial custody on 28.05.2025.
3. Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the petitioner and 2 more accused failed to appear in this case before the committal Court, thereby NBW was issued and the case was split up from PRC.No.3 of 2018 to PRC.No.34 of 2021. He further submitted that the petitioner has one previous case. Hence, he 2/4
opposed the grant of bail.
4. Heard both sides and perused the materials available on record.
5. Considering the facts and circumstances of the case, and taking into account that the petitioner had remained abscond for more than 7 years and that the trial date is now likely to be fixed, this Court is not inclined to grant bail to the petitioner.
