ORDER

These Writ Miscellaneous Petitions have been filed to direct the respondents to open the portal for the BST course for the current 45th batch of GP Rating and 29th batch of CCMC course students and to issue the admit 1/5

card/hall ticket for the students to appear for the exit examinations scheduled on 13.12.2024, and to appoint an Advocate Commissioner as an Officer of the Court to inspect the Maritime Technical Institute of the Petitioner and to verify and note down the compliance of the alleged deficiencies cited in the impugned order of the 1st respondent dated 28.08.2024 in the presence of the respondents 1 and 2 and to file a report before this Court.

2. It is submitted by the learned counsel for the respondents that by the order of the Director General of Shipping, Mumbai dated 21.05.2024, the portal was closed for certain deficiencies.

The learned counsel appearing for the petitioner on the other hand submitted that all the deficiencies have been removed and in that regard, the petitioner submitted a detailed reply by a letter dated 31.05.2024. Hence, he prayed to open the BST Portal and appoint an Advocate Commissioner to inspect the petitioner's institution.

4. Considering the submission made by the learned counsel on either 2/5

side, the respondents are directed to open the portal for the BST course for the current 45th batch of the GP Rating and 29th batch of CCMC course students and issue admit cards / hall tickets for the students to appear for the exit examinations scheduled on 13.12.2024. All the orders passed therein will be subject to the final outcome of the writ petition.

5. It is further directed that the respondents are directed to verify the petitioner's management as to whether the deficiencies have been removed or not, and the respondents shall complete the verification process within a period of three weeks from the date of receipt of a copy of this order. The petitioner management shall give full assistance to the respondents for proper verification.

6. In view of the above, this Court is inclined to appoint Ms.Akila Rajendran [Mobile No.72597 77753 & E.Mail ID.akila.law@gmail.com] as an Advocate Commissioner to accompany with the respondents team to inspect the Petitioner's Management on 24.12.2024 for verification. The Advocate Commissioner shall be paid remuneration of Rs.50,000/- by the petitioner within a period of one week from the date of receipt of a copy of 3/5
