ORDER
This Criminal Original Petition has been filed by the petitioner/defacto complainant seeking for cancellation of anticipatory bail granted to the 1/4
petitioners in Crime No.290 of 2025, on the ground that the bail petitioners are likely to be leave the Country and thereby stalled the judicial process of the Court.

The learned counsel for the petitioner/defacto complainant submitted that it is a case of installation of CCTV cameras inside the house of the victim /petitioner without her knowledge for the purpose of snooping. He further submitted that the anticipatory bail order was obtained without her knowledge and was not able to put forth all the facts before this Court at the time of granting anticipatory bail. Since likelihood of the petitioners to leave the Country, prays to grant cancellation of anticipatory bail granted to the bail petitioners.

The learned counsel for the second and third respondents representing the bail petitioners submitted that there is no occasion for the bail petitioners leaving the Country since already they have filed Divorce Petition for seeking divorce and also Custody Petition for seeking custody of the children and actively conducting the case. He further submitted that the bail petitioners staying in India for nearly eight years and they have no intention to leave the Country and prays to dismiss the present petition.
4. The learned Government Advocate (Crl.Side) appearing for the first 2/4
respondent/State on instructions submitted that investigation in this case is not concluded and also submitted that the petitioners have complied all the anticipatory bail conditions imposed by this Court vide order dated 11.09.2025 in Crl.O.P.No. 24848 of 2025.
5. The present petition seeking anticipatory bail granted to the bail petitioners to be cancelled on the ground that the bail petitioners are likely to be leave the Country. However, it has been placed before this Court that already Divorce proceedings between the defacto complainant and her husband is pending and there are custody proceedings for taking custody of the children born to them is also pending. It is also the fact that the bail petitioners stayed and residing for nearly eight years and they are having properties in this Country.

This Court, after considering all the allegations levelled against the bail petitioners in Crime Number 290 of 2025, granted anticipatory bail to the petitioners after imposing sufficient conditions for ensuring their appearance and participation in the criminal proceedings. Hence, this Court is of the view K.RAJASEKAR, J.

that the present petition has been filed on the speculative basis that the bail petitioners likely to be leave on the Country and also it has not been substantiated by the petitioner/defacto complainant herein. Therefore, this Court is of the view that there is no necessity for cancellation of anticipatory bail granted to the petitioners vide order dated 11.09.2025 in Crl.O.P.No.24848of 2025.
